Staatsloterij Value Claim – Invest in Justice
Between 2000 and 2008, the Staatsloterij engaged in misleading practices. To compensate for this, the Staatsloterij organized a free lottery draw. Loterijverlies represented approximately 200,000 affected customers in this matter. However, the Staatsloterij persuaded 81,200 people to sign a settlement agreement in exchange for free lottery tickets, despite knowing that:
- An agreement existed between the Staatsloterij and Loterijverlies stating that customers would not be approached.
- Loterijverlies had exclusive authority to negotiate a settlement.
- This action would severely harm Loterijverlies’ commercial interests.

The Dutch State Lottery (Staatsloterij) approached customers of Loterijverlies and reached a settlement with at least 81,200 of them, resolving years of deception. This deception was confirmed all the way up to the Dutch Supreme Court. The Staatsloterij misled the public and acted unlawfully for years, as hundreds of millions of euros in advertised prizes never actually existed. As part of the settlement, these customers received €40 and free lottery tickets from the Staatsloterij.
This settlement has caused damage to Loterijverlies. The Staatsloterij’s actions are unlawful toward Loterijverlies for the following reasons:
- The Staatsloterij was aware that this settlement breached contractual agreements between Loterijverlies and its clients. These agreements clearly stated:
Only Loterijverlies has the authority to decide whether a client may accept a settlement proposal. - A contract between Loterijverlies and the Staatsloterij explicitly stipulated that the Staatsloterij would not approach Loterijverlies clients directly.

Why invest in this claim?
Due to these unlawful actions, Loterijverlies has suffered significant damages, including:
• The claim’s value in 2017 regarding 81,200 participants.
• Lost revenue, including the "no cure, no pay" fee percentage.
In a lawsuit against Loterijverlies, the Dutch Tax Authority determined that the claim’s value was at least €13,5 million, based on an independent auditor’s analysis. The Noord-Holland Court confirmed this valuation and ruled that Loterijverlies owed approximately €10 million in taxes. On appeal, Loterijverlies settled with the Tax Authority, partly because the Court of Appeal indicated that a negative ruling could lead to its bankruptcy.
This judicial ruling clearly confirms that the claim had substantial value in 2017 and that the Staatsloterij acted unlawfully. The current claim amounts to at least €5 million, excluding additional damage claims worth hundreds of thousands of euros.
